An Island County Superior Court judge recently sentenced a man to more than four years in prison for driving under the influence, among other charges.

Thanks to a law the Legislature passed in 2007, DUI can become a felony in certain circumstances. For example, suspects can be charged if they have been convicted of four or more DUIs in the past or if the have been convicted in the past of a single intoxication-related vehicular assault or vehicular homicide.

Island County Woman Charged with Driving Under the Influence (DUI) of Meth

A 41-year-old Oak Harbor woman’s wedding night ended badly last November.

According to court records, she was arrested on suspicion of possessing methamphetamine and driving under the influence on the way home from a night in a bridal suite. Her new husband was arrested on an alleged felony warrant from another state, but was released without charges after sitting in jail for 18 days and losing his job.

Island County DUI Driver Drives onto Tidelands and another DUI Driver crashes into apartment complex

Two women were arrested on suspicion of driving under the influence after two unusual accidents in Oak Harbor Sunday, but nobody was injured in either.

In the most spectacular accident, Oak Harbor Police Chief Rick Wallace said that a 22-year-old Oak Harbor woman was driving a Volkswagen Beetle southbound on Midway at about 12:30 Sunday night. The car traveled across Pioneer Way without stopping, careened down an embankment and ended up in the tidelands.

Texas Man Refuses BAC in Anacortes, Skagit County then gets DUI

On Sunday, February 21, 2010, an Anacortes police officer stopped a car in the 1000 block of Commercial Avenue for speeding just after midnight. The driver, a 30-year-old Texas man, smelled strongly of intoxicants and said he was unaware how fast he was traveling. The man had bloodshot, watery eyes and allegedly admitted he had three beers. He failed field sobriety tests and was arrested on a charge of DUI. He refused to take a breath test at the station and was booked into jail. This DUI will undoubtedly be another DUI for Anacortes Municipal Court.

Anacortes, Skagit County Man hides under bed then arrested for DUI

On Sunday, February 21, 2010, Anacortes Police Officers responded to the report of a hit and run accident in which a Suburban hit a parked car in the 2700 block of Q Avenue just after 9 p.m. A witness reported the Suburban drove around the block and parked behind a building, then the male driver ran into a nearby apartment. At the apartment a woman told officers he was not there. Officers found the 31-year-old man hiding under a bed. He was arrested on a charge of hit and run. The man smelled strongly of intoxicants, had watery eyes and kept repeating himself. He was taken to the police station where he was initially uncooperative and would not identify himself. He eventually gave his name and provided breath samples significantly more than twice the legal limit. He faces charges of DUI and hit and run. He was released to his wife. Yet another DUI charge for the Anacortes Municipal Court.

Anacortes, Skagit County Man hits Pole then hit with DUI

On Monday, February 22, 2010, Anacortes Police Officers responded to a report that a vehicle hit a power pole in the 8300 block of South March Point Road around 5:17 p.m. It was reported the driver appeared to be uninjured and walked away from the scene, leaving the vehicle partially blocking the road. Police were told a short time later that a man matching the driver’s description was hiding in a car at a nearby car dealership and told an employee he needed a ride before the police arrive.
Police found the suspected driver, a 50-year-old Anacortes man, when friends arrived to pick him up. He reportedly smelled of intoxicants and admitted he had a couple of cocktails. He consented to an eye test but refused to perform additional field sobriety tests. He was arrested on charges of DUI and hit and run. He provided samples over the legal limit. He was cited and released to sober friends.

Oak Harbor, Island County Man Arrested for DUI in Anacortes, Skagit County

On February 12, 2010, a 26-year-old Oak Harbor man was arrested by Anacortes Police in Anacortes on charges of DUI and felony hit and run after he allegedly struck an 82-year-old pedestrian who was walking with two caregivers on Whistle Lake Road around 11:45 a.m. Saturday, Feb. 13.
Witnesses provided a license plate number for the fleeing vehicle and an officer stopped it near 37th Street and Commercial Avenue. The driver reportedly had an overwhelming smell of intoxicants on him and appeared to have difficulty staying awake. He had slurred speech and allegedly admitted he had “a couple.”
He failed field sobriety tests and was arrested on charges of DUI and hit and run. He provided breath samples approximately two and a half times the legal limit. He was booked into jail. Another case for the very busy Skagit County Court.

Donuts Equal DUI in Anacortes, Skagit County

On February 24, 2010, an Anacortes Police officer saw a vehicle spinning its tires and doing “donuts” in a parking lot in the 2900 block of Commercial Avenue around 11:21 p.m. The vehicle left the parking lot and continued to spin and smoke its tires, and the officer stopped it in the 1000 block of 29th Street. The driver, a 29-year-old Anacortes man, was unsteady on his feet as he got out of his car and was arrested on a charge of reckless driving.
The man also had a suspended driver’s license and three warrants on DUI charges. A marijuana pipe was found in his pocket and he allegedly admitted drinking “half a bottle of tequila.” The man said he was driving in a reckless fashion because he had been drinking. He failed field sobriety tests and allegedly told the officer, “I want to be honest with you … I’m drunk.” He provided breath samples more than twice the legal limit. He was booked into jail on multiple charges. Lots more work at the Anacortes Municipal Court.

Bouncing over Turtles leads to DUI for Mount Vernon, Skagit County Man

On Saturday, February 13, 2010, a 57-year-old Mount Vernon man was arrested by Anacortes Police on a charge of DUI after an officer saw his van repeatedly traveling out of its lane on Highway 20 around 1:45 a.m. The vehicle was speeding and the driver allegedly told the officer he “kept bouncing over the turtles.” The man showed several signs of intoxication and told the officer he had a couple beers. He failed field sobriety tests and provided breath samples almost twice the legal limit. He was cited and released to his wife. More work for the Anacortes Municipal Prosecuting Attorney.

DUI Arrest in Washington State needs a Valid Stop or your vehicle

The DUI Stop

The officer must have a valid reason to stop and detain you. All citizens in this country have the right to travel free of unjustified police interference. Random stops of drivers by police are illegal and police stops based upon a hunch are also illegal. A roadblock is considered a random stop and is not permitted in Washington, although roadblocks are permitted in many other states and Canada. Importantly, if the officer has no legal basis to stop you the evidence he gathers following the stop must be suppressed and your case dismissed.

Preceding the stop it is not necessary that the officer observe a driver actually “driving under the influence” or even driving that is “typical” of such an offense (weaving all over the road). In fact many people who are stopped and subsequently arrested for a DUI were stopped for other reasons such as having a tail light out, driving with no lights on at night, or expired registration. Police are trained and encouraged to look for certain driving mannerisms that might indicate a chance that the driver is driving under the influence. The National Highway Traffic Safety Administration (NHTSA) has produced a pocket-size booklet intended primarily for law enforcement entitled Guide for Detecting Drunk Drivers at Night, DOT HS-805-711 (available free of charge from NHTSA, Administrative Operations Division, Room 4423, 400 Seventh Street, N.W., Washington, DC 20590).
